If you purchased a Grow-Up Plan or a College Plan (also known as the “Gerber Life Insurance College Plan”) from Gerber Life Insurance Company, you could be affected by a class action lawsuit.


  • The lawsuit relates to claims that Gerber Life Insurance Company (“Gerber Life”) engaged in fraudulent advertising and deceptively named and marketed the Gerber Life Grow-Up Plan and Gerber Life College Plan (also known as the “Gerber Life Insurance College Plan”), respectively.  The lawsuit is pending in the United States District Court for the Southern District of New York, and is entitled Loguidice, et al. v. Gerber Life Insurance Company, No. 20-CV-3254.  Gerber Life denies these claims and the Court has not decided whether Gerber Life did anything wrong.  However, the Court has certified the case as a class action.  If you purchased a Grow-Up Plan from Gerber Life between April 24, 2014 and September 27, 2024, you are a member of the Grow-Up Plan Class that is seeking money from Gerber Life.  If you purchased a College Plan (also known as the “Gerber Life Insurance College Plan”) from Gerber Life between April 24, 2014 and September 27, 2024, you are a member of the College Plan Class that is also seeking money from Gerber Life.  Collectively, the Grow-Up Plan Class and College Plan Class are referred to as the “Classes.” 
     
  • There is no money available now, and no guarantee there will be. Class Members who do nothing will automatically remain a part of the lawsuit and will keep the possibility to get money or benefits that may come from a trial or settlement. Class Members who do nothing will be bound by any Court decisions or order made in the case and will give up the right to sue Gerber Life in a different lawsuit about the same legal claims brought in this lawsuit. You will not need to come to Court or participate in the litigation if you remain a Class Member because the Class Representatives and Class Counsel appointed by the Court will prosecute the litigation for all Class Members with no individual cost to you. 
     
  • Your legal rights are affected, so please read this notice carefully.
     

Your Legal Rights and Options 

Do Nothing

Stay in this lawsuit. Await the outcome. Give up the right to bring a separate lawsuit about the same issues in this case regardless of the outcome. Receive a payment or other benefit if there is a settlement or judgment for the Classes. Be bound by any decision in the case, even if there is no recovery.

Exclude Yourself and Opt Out

Get no recovery from the lawsuit. Keep the rights to sue and bring a separate lawsuit against Gerber Life about the same issues in this lawsuit, if you choose to do so.
